Welcome to Swiftwear. These Terms and Conditions (“Terms”) govern your use of our website swiftwear.nl and any purchases you make from us. By accessing our website and placing an order, you accept these Terms in full. Please read them carefully.

1. Scope of Agreement

These Terms apply to all offers, orders, purchases, and deliveries between Swiftwear ("we", "us", "our") and you ("you", "your"). Any deviation from these Terms is valid only when expressly agreed in writing.

2. Products and Availability

• Product information, pricing, and availability are provided in good faith but may contain errors.

• Images are for illustrative purposes only — actual colors and details may vary.

• We reserve the right to modify product specifications or discontinue items without notice.

3. Pricing and Payment

• All prices are in Euros (€) and include VAT unless otherwise noted.

• Shipping costs are calculated at checkout and clearly shown before payment.

• Accepted payment methods: iDEAL, Klarna, Credit Card, ApplePay.

• Payment is processed at the time of order unless otherwise stated.

• In case of pricing errors, we reserve the right to cancel the order and refund any payments received.

4. Shipping and Delivery

• We ship within The Netherlands .

• We are not liable for delivery delays beyond our control (e.g., customs, carrier performance).

• Title and risk transfer to you upon handover to the carrier.

• Please double-check your delivery address — we’re not responsible for undelivered orders due to incorrect addresses.

5. Pre-Orders

• Pre-orders are items ordered before they are in stock.

• Payment is taken when the order is placed.

• All delivery timeframes are estimates. For pre-orders, delivery may exceed 30 days from the order date. By placing a pre-order, you agree to the estimated delivery period stated on the product page at the time of purchase.

• If in-stock and pre-order items are ordered together, we'll ship when all are available — unless otherwise arranged.

• You may cancel a pre-order before shipping; refunds for cancelled pre-orders will be processed within 14 business days after your cancellation has been confirmed. Please note that for standard returns (after receiving the goods), refunds are processed within 30 days from the day we receive the returned goods, as outlined in section 6 of these Terms and Conditions.

• Whether a product is a regular order or a pre-order will be clearly indicated on the product page. If it is not marked as a pre-order, it will be considered a regular order.

6. Returns and Refunds

You have the right to cancel your order within 30 days without giving a reason, starting from the day you or your appointed party (not the carrier) receives the goods.

6.1 How to Cancel

• Inform us clearly (e.g., via email: info@swiftwear.nl) within the 30-day period.

• We will reimburse you within 30 days from the day we receive the returned goods, using the same payment method—without any fees.

6.2 Conditions for Returns

• To be eligible for a return, please ensure that:

  • The goods were received by you within the last 30 days.

  • The goods must be returned in packaging that adequately protects them from damage during transit. This does not need to be the original shipping packaging, but the item must be unused, undamaged, and include any original tags or labels.

  The following items cannot be returned:

  • Goods made to your specifications or clearly personalized.

  • Goods that, by their nature, are not suitable for return (e.g., items that have been worn, used, or damaged after delivery).

  • Goods that are not suitable for return due to health protection or hygiene reasons and have been unsealed after delivery.

  • Goods that, after delivery, are inseparably mixed with other items.

  We reserve the right to refuse returns of any merchandise that does not meet the above conditions, at our sole discretion.

6.3 Returning Goods & Shipping Costs

• Unless the return is due to a defective or incorrect item, you are responsible for the cost and risk of returning the goods to us. Returns must be sent to:

  We strongly recommend using a trackable and insured shipping method, as we cannot issue a refund without receiving the goods or proof of their delivery. We are not responsible for items lost or damaged in transit.

7. Limitation of Liability

• We are not liable for indirect, incidental, or consequential damages arising from your use or misuse of our site or products.

• These terms do not affect any consumer rights you may have under applicable law.

• All content on swiftwear.nl (design, text, images, logos) is owned by or licensed to us and protected by copyright and trademark law.

• You may not copy, distribute, or use our content without prior written permission.

9. Governing Law and Disputes

• These Terms are governed by the laws of the Netherlands.

• Disputes fall under the jurisdiction of the competent courts in Nieuwegein, Netherlands.

10. Amendments

• We may update these Terms at any time.

• Material changes will be communicated via email or website notification.
